The Probate Process, In Its Simplest Form...

1.  Authenticate the Last Will and Testament (if written will exists).

2.  Appoint the Executor (determine by will) OR Administrator (determined by state).

3.  Locate the Estate Assets.

4.  Identify and Notify Creditors.

5.  Pay the Outstanding Debts.

6.  Prepare and File Tax Returns.

7.  Distribute the Estate Assets.
